PLANNING BOARD MINUTES
December 17, 2013
7:15 P.M.

A regular meeting of the Egg Harbor City Planning Board was held on December 17, 2013 with Chairman Gerhard Mueller presiding. Other members in attendance were Vice Chairman Richard Colby, Mayor Jiampetti, City Official Keith Adams, Council President Edward Dennis, Regular Members Miriam Mueller, Dennis McKenna, Solicitor Jim Schroeder, City Planner Tim Michel, Engineer Ryan McGowan and Secretary Donna Heffley. (Not present were Alternate #1 Jack Peterson and Alternate #2 Gladys Torres).

Roll Call: Mayor Jiampetti yes, Mr. Dennis yes, Mr. Adams yes, Mr. Colby yes, Mrs. Mueller yes, Mr. McKenna yes, Mr. Peterson no, Mrs. Torres no, Mr. Mueller yes, Mr. Schroeder yes, Mr. Michel yes, Mr. McGowan yes and Secretary Donna Heffley yes.

The Chairman called the meeting to order and made the following announcement.

This meeting was advertised pursuant to the NJ Open Public Meeting Act. N.J.S.A. 1:4-6 seq. Notices were sent to official publications for the Planning Board, the Press of Atlantic City, the Egg Harbor News and the Atlantic Current. A copy of the notice was posted on the bulletin board of the Egg Harbor City Municipal Building.

The Chairman directed the Secretary to enter this public announcement into the minutes.

Approval of Minutes: October 15, 2013
Upon motion made by Mr. Dennis, seconded by Mr. Colby and carried the October 15, 2013 meeting minutes were approved.

Mr. Emmer the Attorney representing the Applicant Egg Harbor City Station, LLC was present and stated he was informed that the Applicant must apply to the Zoning Board instead of the Planning Board.
Mr. Michel explained to the Board why this application is a matter for the Zoning Board of Adjustment to review. The Applicant is interested in expanding a non-conforming use which requires Zoning Board approval.
Mr. Michel noted Mr. Emmer did submit a 200 foot notice for this application and all other necessary paperwork and fees before it was determined that the Planning Board does not have jurisdiction to review this application and he must go before the Zoning Board of Adjustment.

Mr. Emmer wanted to know if his 200 foot list he already completed will serve as certification for the Zoning Board. Mr. Michel noted a new 200 foot list will have to be completed because the application that was submitted to the Planning Board assumed it was a permitted use. The notice that will be required to go before the Zoning Board will have to state it is a non-permitted use and the Applicant is seeking approval for the expansion of a non-conforming use. Mr. Michel advised the Attorney that the Applicant will be applying for a minor site plan and a D use variance.

The City Professionals offered to meet with the Applicant and his Attorney Mr. Emmer to discuss details that must be addressed on the plans.

Council Report: Mayor Jiampetti thanked the Road Department for an outstanding job with the water crises on Thanksgiving Day. Council and Emergency Management also worked very hard to address this problem quickly.

Mr. Dennis announced the dedication of the New Water Treatment Plant which will take place on Friday December 20, 2013 at 10:00a.m. The New Plant is about 98% complete, will be mostly maintenance free and has been built to last a definite asset to the City. Mr. Dennis noted the last time the City had a new water plant was in about 1902.
